00 HOUSE BILL NO. 211 01 "An Act relating to motor vehicle window tinting." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 28.35 is amended by adding a new section to article 3 to read: 04 Sec. 28.35.271. Motor vehicle window tinting. (a) Except as provided in (b) 05 of this section, a person may not operate a motor vehicle on a highway if the motor 06 vehicle has window tinting 07 (1) on the portion of the front windshield of the vehicle that is below 08 the top five inches; 09 (2) that is mirrored; or 10 (3) that reduces total light transmittance to less than 35 percent on a 11 side window, quarter glass, or back glass. 12 (b) A person may operate a vehicle with tinted windows if 13 (1) the tinting complies with standards set in regulations by the 14 Department of Public Safety and the vehicle is 15 (A) a limousine or passenger bus used to transport persons for

01 hire; 02 (B) a motor home; or 03 (C) identified by the vehicle manufacturer as a multipurpose 04 vehicle; or 05 (2) a driver or passenger who frequently travels in the vehicle is 06 required for a medical reason to be shielded from the direct rays of the sun and the 07 (A) medical reason is certified annually by a physician licensed 08 under 08.64; and 09 (B) certification required by (A) of this paragraph is carried in 10 the vehicle. 11 (c) Violation of this section is an infraction. 12 (d) In this section, "light transmittance" means the ratio, expressed as a 13 percentage, of the total amount of light that is allowed to pass through a window, 14 including glazing, to the total amount of light falling on the window. 15 * Sec. 2. 13 AAC 04.223(b)(2), 13 AAC 04.223(b)(3), and 13 AAC 04.223(h) are annulled.
