01 "An Act relating to contracts for highway construction projects."                                                       
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 19.10.180 is amended by adding a new subsection to read:                                           
04            (b)  In a contract for materials and supplies under this section, the department                             
05       shall require, as terms of the contract, that the                                                                 
06                 (1)  load of sand, gravel, rock, or similar materials for the construction                              
07       project be covered; and                                                                                           
08                 (2)  penalty for an uncovered load be that the cost of the load will not                                
09       be paid.                                                                                                          
10    * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to                          
11 read:                                                                                                                   
12       APPLICABILITY. AS 19.10.180(b), enacted by sec. 1 of this Act, applies to contracts                               
13 entered into on or after the effective date of sec. 1 of this Act.
