00 HOUSE BILL NO. 191 01 "An Act relating to the practice of medicine and osteopathy." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 08.64 is amended by adding a new section to read: 04 Sec. 08.64.372. Maintenance of certification and osteopathic continuous 05 certification. (a) Nothing in this chapter may be construed to require a physician to 06 secure a maintenance of certification as a condition of licensure, reimbursement, 07 employment, or admitting privileges at a hospital in this state. In this subsection, 08 "maintenance of certification" means a proprietary program that requires an individual 09 to engage in periodic testing, self-assessment, peer evaluation, or other activities to 10 obtain and maintain a specialty medical certification. 11 (b) Nothing in this chapter may be construed to require an osteopath to secure 12 an osteopathic continuous certification as a condition of licensure, reimbursement, 13 employment, or admitting privileges at a hospital in this state. In this subsection, 14 "osteopathic continuous certification" means a proprietary program that requires an 15 individual to engage in periodic testing, self-assessment, peer evaluation, or other

01 activities to obtain and maintain a specialty osteopathic certification. 02 * Sec. 2. AS 18.20 is amended by adding a new section to read: 03 Sec. 18.20.105. Limitations on maintenance of certification and 04 osteopathic continuous certification. (a) A hospital may not revoke, suspend, 05 condition, restrict, or refuse to grant hospital privileges to a person licensed under 06 AS 08.64 to practice as 07 (1) a physician because of the physician's failure to participate in or 08 secure a maintenance of certification; or 09 (2) an osteopath because of the osteopath's failure to participate in or 10 secure an osteopathic continuous certification. 11 (b) In this section, 12 (1) "maintenance of certification" means a proprietary program that 13 requires an individual to engage in periodic testing, self-assessment, peer evaluation, 14 or other activities to obtain and maintain a specialty medical certification; 15 (2) "osteopathic continuous certification" means a proprietary program 16 that requires an individual to engage in periodic testing, self-assessment, peer 17 evaluation, or other activities to obtain and maintain a specialty osteopathic 18 certification.
