01 "An Act relating to the certificate of need program for health care facilities; and                                     
02 providing for an effective date."                                                                                       
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 18.07.031(a) is amended to read:                                                                 
05 (a)  Except as provided in (c) and (d) of this section, a person may not make an                                        
06 expenditure of $1,000,000 or more for any of the following in a location within 75                                  
07 miles of another health care facility unless authorized under the terms of a certificate                            
08       of need issued by the department:                                                                                 
09                 (1)  construction of a health care facility;                                                            
10                 (2)  alteration of the bed capacity of a health care facility; or                                       
11                 (3)  addition of a category of health services provided by a health care                                
12       facility.                                                                                                         
13    * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to                          
14 read:                                                                                                                   

01 APPLICABILITY. AS 18.07.031(a), as amended by sec. 1 of this Act, applies to the                                        
02 construction or alteration of, or addition of a category of health services provided by, a health                       
03 care facility initiated on or after the effective date of this Act and to applications pending                          
04 under AS 18.07.031 on the effective date of this Act. For a health care facility that is located                        
05 more than 75 miles from another health care facility and that has an existing certificate of                            
06 need issued by the Department of Health and Social Services under AS 18.07.031 or modified                              
07 under AS 18.07.061 before the effective date of this Act, the Department of Health and Social                           
08 Services may not take any action to revoke, enforce, or modify the terms of the certificate.                            
09    * Sec. 3. This Act takes effect July 1, 2020.
