01 "An Act requiring a nonresident to be accompanied by a guide or resident spouse or                                      
02 relative when hunting certain caribou; and providing for an effective date."                                            
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 16.05.407(b) is amended to read:                                                                   
05 (b)  An applicant for a nonresident big game tag for the taking of an animal                                            
06 specified in (a) or (g) of this section shall first furnish to the state, on a form provided                        
07 by the state, an affidavit showing that the applicant will be personally accompanied                                    
08 while hunting by a person who is qualified under the terms of (a) of this section. A                                    
09       person who falsifies the required affidavit is guilty of perjury under AS 11.56.200.                              
10    * Sec. 2. AS 16.05.407(d) is amended to read:                                                                      
11 (d)  A nonresident who violates (a) or (g) of this section, or who fails to                                         
12 furnish an affidavit under (b) of this section, is guilty of a misdemeanor and upon                                     
13 conviction is punishable by imprisonment for not more than one year, or by a fine of                                    
14       not more than $5,000, or by both.                                                                                 

01    * Sec. 3. AS 16.05.407(f) is amended to read:                                                                      
02 (f)  An applicant for a nonresident hunt permit for the taking of an animal                                             
03 specified in (a) or (g) of this section shall, if requested by the department, first furnish                        
04 to the department proof of prior authorization to use federal, state, or private land                                   
05 where the permit hunt will occur. The authorization shall be provided to the applicant                                  
06 by the registered guide-outfitter or master guide-outfitter with whom the applicant has                                 
07       contracted to guide the permit hunt.                                                                              
08    * Sec. 4. AS 16.05.407 is amended by adding a new subsection to read:                                              
09            (g)  In addition to the animals listed under (a) of this section, it is unlawful for                         
10       a nonresident to hunt, pursue, or take caribou from the Porcupine, Central Arctic, or                             
11       Western Arctic caribou herds unless the nonresident is accompanied by a person who                                
12       is qualified under the terms of (a) of this section.                                                              
13    * Sec. 5. This Act takes effect January 1, 2018.
