00 HOUSE BILL NO. 201 01 "An Act relating to municipal regulation of trapping; and providing for an effective 02 date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 16.05.930 is amended by adding a new subsection to read: 05 (h) Nothing in this chapter prevents a municipality from regulating the 06 practice of trapping within its boundaries, to the extent authorized under 07 AS 29.35.052. 08 * Sec. 2. AS 29.35 is amended by adding a new section to read: 09 Sec. 29.35.052. Regulation of trapping. (a) A municipality may regulate 10 trapping to protect life and property within its boundaries and may exempt trappers 11 from municipal regulation for good cause. Ordinances a municipality may enact under 12 this section include ordinances that impose 13 (1) trap identification requirements; 14 (2) signage or other notice requirements for set or placed traps;

01 (3) restrictions on the use of types of traps likely to cause injury or 02 damage to persons or property, including domestic animals; 03 (4) prohibitions on the setting or placement of traps in areas or 04 locations where they are likely to cause injury or damage to persons, property, or 05 nontargeted species. 06 (b) This section applies to home rule and general law municipalities. 07 (c) Nothing in this section prohibits the 08 (1) Department of Environmental Conservation from exercising its 09 powers to stop the spread of disease; 10 (2) Department of Fish and Game from exercising its powers to 11 manage the state's fish and wildlife; or 12 (3) Department of Public Safety from exercising its powers to protect 13 public health and safety. 14 (d) In this section, "trapping" has the meaning given in AS 16.05.940. 15 * Sec. 3. This Act takes effect January 1, 2018.
