01 Relating to school district participation in the school construction grant program.

03    * Section 1. AS 14.11.008(a) is amended to read:                                                                     
04 (a)  In order to receive a grant under this chapter or an appropriation under                                           
05 AS 37.05.560, a district must provide a percentage share of the project cost, as                                        
06 determined under (b) or (c) of this section. Except as provided in (d) or (g) of this                                 
07 section, a [A] district shall provide the required participating share within three years                             
08 after the date that the appropriation bill funding the grant is passed by the legislature.                              
09    * Sec. 2. AS 14.11.008 is amended by adding a new subsection to read:                                                
10 (g)  The commissioner may extend the time allowed for a district to provide                                             
11 the required participating share for an additional period of not more than seven years if                               
12 the district applies to the commissioner in writing to request an extension and                                         
13 demonstrates good cause for the requested extension. The commissioner may find                                          

01       good cause if                                                                                                     
02                 (1)  a request for extension identifies a project constraint that requires a                            
03       reasonable extension of time;                                                                                     
04                 (2)  the extension will not jeopardize the successful completion of the                                 
05       project as described in a grant agreement under AS 14.11.017;                                                     
06                 (3)  the extension will not result in an increase of state funding of the                               
07       project cost; and                                                                                                 
08                 (4)  the district demonstrates a good faith effort to secure funding for its                            
09       participating share within the time required by (a) of this section and reasonably                                
10       expects to secure the funding within the additional time requested by the extension.                              
11    * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to                            
12 read:                                                                                                                   
13       APPLICABILITY. AS 14.11.008(a), as amended by sec. 1 of this Act, and                                             
14 AS 14.11.008(g), enacted by sec. 2 of this Act, apply to a grant received under AS 14.11.008 -                          
15 14.11.020 before, on, or after the effective date of this Act.
