00 HOUSE BILL NO. 116 01 "An Act relating to the art requirements for certain public buildings and facilities and 02 to the funding of works of art." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 44.27.052(a) is amended to read: 05 (a) The council may 06 (1) hold public and private hearings; 07 (2) enter into contracts, within the limit of funds available, with 08 individuals, organizations, and institutions for services furthering the educational 09 objectives of the council's programs; 10 (3) enter into contracts, within the limit of funds available, with local 11 and regional associations for cooperative endeavors furthering the educational 12 objectives of the council's programs; 13 (4) accept gifts, contributions, and bequests of unrestricted funds from 14 individuals, foundations, corporations, and other organizations or institutions for the
01 purpose of furthering the educational objectives of the council's programs; 02 (5) make and sign agreements and do and perform any acts necessary 03 to carry out the purposes of AS 44.27.040 - 44.27.058 [AS 44.27.040 - 44.27.060]; 04 and 05 (6) adopt regulations under AS 44.62 (Administrative Procedure Act) 06 to carry out the provisions of AS 44.27.040 - 44.27.058 [AS 44.27.040 - 44.27.060]. 07 * Sec. 2. AS 44.35.030 is amended to read: 08 Sec. 44.35.030. Construction of memorials to Alaska veterans. The 09 Department of Military and Veterans' Affairs may construct memorials to Alaska 10 veterans. A memorial constructed under this section is not subject to AS 35.15 [OR 11 AS 35.27]. 12 * Sec. 3. AS 35.27.010, 35.27.020, 35.27.030; AS 44.27.050(5), and 44.27.060 are repealed. 13 * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section to 14 read: 15 APPLICABILITY. (a) This Act does not apply to the construction of a building or 16 facility if, before the effective date of this Act, the Department of Transportation and Public 17 Facilities has entered into a contract for all or part of the construction of the public building or 18 facility or for the design, construction, mounting, or administration of a work of art for the 19 public building or facility under AS 35.27.020, repealed by sec. 3 of this Act. In this 20 subsection, 21 (1) "building" or "facility" has the meaning given in AS 35.27.030, repealed 22 by sec. 3 of this Act; 23 (2) "construction" includes planning and design. 24 (b) This Act does not apply to the commissioning, purchase, or expenses of a work of 25 art under AS 44.27.060(c), repealed by sec. 3 of this Act, for a building or facility if, before 26 the effective date of this Act, the Alaska State Council on the Arts has entered into a contract 27 for the commissioning, purchase, or expenses of the work of art for the building or facility 28 under AS 44.27.060(c), repealed by sec. 3 of this Act. In this subsection, "building" or 29 "facility" has the meaning given in AS 44.27.060(d), repealed by sec. 3 of this Act.
