00 CS FOR SENATE BILL NO. 170(RES) 01 "An Act authorizing the Department of Natural Resources, division of geological and 02 geophysical surveys, to collect fees for facilities, equipment, products, and services; 03 relating to accounting for certain program receipts; and providing for an effective 04 date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. AS 37.05.146(c) is amended by adding a new paragraph to read: 07 (88) fees collected by the Department of Natural Resources, division 08 of geological and geophysical surveys, under AS 41.08.045. 09 * Sec. 2. AS 41.08.030 is amended to read: 10 Sec. 41.08.030. Printing and distribution of reports. The state geologist 11 shall print and publish an annual report and [SUCH] other special and topical reports 12 and maps as may be desirable for the benefit of the state, including the printing or 13 reprinting of reports and maps made by other persons or agencies, where authorization 14 to do so is obtained. 01 RECEIVED FROM THESE SALES SHALL BE PAID INTO THE GENERAL 02 FUND.] 03 * Sec. 3. AS 41.08 is amended by adding a new section to read: 04 Sec. 41.08.045. Fees for facilities, equipment, products, and services. (a) 05 Except as provided in (c) of this section, the division of geological and geophysical 06 surveys may charge and collect a fee for facilities, equipment, products, or services 07 that the division offers, including 08 (1) rental of space for confidential sample storage; 09 (2) rental of sample viewing facilities; 10 (3) retrieval, cutting, splitting, processing, or sampling of geological 11 materials; 12 (4) use of equipment, including microscopes; and 13 (5) analyses, maps, reports, data, or products authorized by the 14 division. 15 (b) The division of geological and geophysical surveys shall establish fees that 16 may be charged and collected under (a) of this section by regulation. Before setting the 17 fees, the division shall consider at public hearings the 18 (1) cost to the state of operating the facility or providing the service or 19 equipment; 20 (2) normal fees charged for similar facilities, equipment, or services by 21 governmental and nongovernmental entities; 22 (3) cost of administering a fee collection program for the facility, 23 equipment, or service; and 24 (4) public interest. 25 (c) The division shall waive fees under this section for a student who uses 26 facilities, equipment, products, or services for educational purposes. 27 (d) Fees collected under this section shall be separately accounted for under 28 AS 37.05.142. 29 * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section to 30 read: 31 TRANSITION: REGULATIONS. The Department of Natural Resources may adopt
01 regulations necessary to implement the changes made by secs. 2 - 3 of this Act. The 02 regulations take effect under AS 44.62 (Administrative Procedure Act), but not before the 03 effective date of secs. 2 - 3 of this Act. 04 * Sec. 5. Section 4 of this Act takes effect immediately under AS 01.10.070(c). 05 * Sec. 6. Except as provided in sec. 5 of this Act, this Act takes effect July 1, 2016.
