AS 11.66.280(2) is amended to read: 04 (2) "gambling" means that a person stakes or risks something of value 05 upon the outcome of a contest of chance or a future contingent event not under the 06 person's control or influence, upon an agreement or understanding that that person or 07 someone else will receive something of value in the event of a certain outcome; 08 "gambling" does not include 09 (A) bona fide business transactions valid under the law of 10 contracts for the purchase or sale at a future date of securities or commodities 11 and agreements to compensate for loss caused by the happening of chance, 12 including contracts of indemnity or guaranty and life, health, or accident 13 insurance; 14 (B) playing an amusement device that 15 (i) confers only an immediate right of replay not

01 exchangeable for something of value other than the privilege of 02 immediate replay [;] and [(ii)] does not contain a method or device by 03 which the privilege of immediate replay may be cancelled or revoked; 04 (ii) confers only tickets, credits, allowances, tokens, 05 or anything of value that can be redeemed for toys, candy, or 06 electronic novelties offered at the same facility where the 07 amusement device is located; or 08 (iii) allows a player to manipulate a claw machine or 09 similar device within an enclosure and enables a person to receive 10 merchandise directly from the machine; or 11 (C) an activity authorized by the Department of Revenue under 12 AS 05.15; 13 * Sec. 2. AS 11.66.280(3) is amended to read: 14 (3) "gambling device" means any device, machine, paraphernalia, or 15 equipment that is used or usable in the playing phases of unlawful gambling, whether 16 it consists of gambling between persons or gambling by a person involving the playing 17 of a machine; "gambling device" does not include 18 (A) lottery tickets, policy slips, or other items used in the 19 playing phases of lottery or policy schemes; or 20 (B) an amusement device [AS DESCRIBED IN (2)(B) OF 21 THIS SECTION]; 22 * Sec. 3. AS 11.66.280 is amended by adding a new paragraph to read: 23 (12) "amusement device" includes arcade-style games, pinball 24 machines, countertop machines, novelty arcade games, sports-themed games, 25 shuffleboard tables, claw machines, pool tables, shooting galleries, bowling, and a 26 similar machine, device, or apparatus that provides amusement, diversion, or 27 entertainment; "amusement device" does not include casino-style games, draw games, 28 slot machines, roulette wheels, craps, video poker, or any other game that is a contest 29 of chance.
