00 SENATE BILL NO. 48 01 "An Act relating to a reduced fee for a nonresident hunting or sport fishing license and 02 a big game tag for qualifying former state residents; and relating to the requirements 03 for a nonresident hunting or sport fishing license." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 16.05.403 is amended by adding new subsections to read: 06 (d) The department may issue a nonresident "come home to hunt or fish" 07 hunting or sport fishing license to a nonresident at least 18 years of age who 08 (1) is a United States citizen; 09 (2) has held the corresponding resident license in the state in the past; 10 (3) pays the fee for that resident license under AS 16.05.340; and 11 (4) is sponsored by a person who meets the requirements of (f) of this 12 section. 13 (e) A nonresident licensed under (d) of this section 14 (1) may purchase one nonresident big game tag each year for the

01 resident fee, if any, under AS 16.05.340; 02 (2) may not hunt or fish unless personally accompanied by the 03 nonresident's sponsor; and 04 (3) is exempt from the requirement of AS 16.05.407(a)(1). 05 (f) An applicant for a nonresident "come home to hunt or fish" license shall 06 first furnish to the state, on a form provided by the state, an affidavit attesting that the 07 applicant meets the requirements of (d) of this section and will be personally 08 accompanied while hunting or fishing by a sponsor who holds a valid resident license 09 for that sport, is over 19 years of age, and is related to the nonresident, within and 10 including the second degree of kindred, by marriage or blood. A person who falsifies 11 the required affidavit is guilty of perjury under AS 11.56.200. 12 (g) The department may not issue more than 1,000 licenses for each sport 13 under (d) of this section. 14 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 15 read: 16 TRANSITION: REGULATIONS. The Department of Fish and Game may adopt 17 regulations necessary to implement the changes made by this Act. The regulations take effect 18 under AS 44.62 (Administrative Procedure Act), but not before the effective date of this Act.
