01 "An Act relating to industrial hemp; and relating to controlled substances."                                            
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 11.71.090(b) is amended by adding a new paragraph to read:                                       
04                 (4)  "industrial hemp" means all parts and varieties of the plant                                       
05       Cannabis sativa L. containing not more than 0.3 percent tetrahydrocannabinol.                                     
06    * Sec. 2. AS 11.71.090 is amended by adding a new subsection to read:                                              
07            (c)  In a prosecution under AS 11.71.030 - 11.71.060 charging the                                            
08       manufacture, delivery, possession, possession with intent to manufacture or deliver, or                           
09       display of a schedule VIA controlled substance, it is an affirmative defense that the                             
10       controlled substance is industrial hemp.                                                                          
11    * Sec. 3. AS 17.38.200 is amended by adding a new subsection to read:                                              
12            (j)  An individual manufacturing, delivering, or displaying industrial hemp is                               
13       not required to apply for licensure or be licensed under this section. In this subsection,                        
14       "industrial hemp" has the meaning given in AS 11.71.090.
