01 "An Act exempting certain mining activities and processes from certain state water                                      
02 regulations."                                                                                                           
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 46.03 is amended by adding a new section to read:                                                  
05            Sec. 46.03.085. Exemption of mining activities from state water standards.                                 
06       Notwithstanding any other provision of law, a mining activity or process is exempt                                
07       from any statute or regulation adopted under this chapter that establishes a more                                 
08       stringent water quality requirement or standard than federal law if the mining activity                           
09       or process                                                                                                        
10                 (1)  does not use chemicals; and                                                                        
11                 (2)  uses only water, gravity, and motion to extract and process the                                    
12       desired minerals.
