00 HOUSE BILL NO. 242 01 "An Act relating to the salary and per diem of a member of the legislature." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 24.10.100 is amended by adding a new subsection to read: 04 (b) Unless, within the first 90 consecutive days of a regular legislative session, 05 including the day the legislature first convenes in that regular session, a bill has been 06 passed by the legislature that fully funds an operating budget, a member of the 07 legislature is not eligible for a salary after that 90-day period until the first day after a 08 bill has been passed by the legislature that fully funds an operating budget, or the first 09 day of the next regular legislative session, whichever occurs earlier. In this subsection, 10 "passed by the legislature" has the meaning given in AS 01.10.070. 11 * Sec. 2. AS 24.10.130(b) is amended to read: 12 (b) Legislators and officers and employees of the legislative branch of 13 government may be entitled to a per diem allowance; however, if a bill that fully 14 funds an operating budget has not, within the first 90 consecutive days of a 15 regular legislative session, including the day the legislature first convenes in that

01 regular session, been passed by the legislature, a member of the legislature is not 02 entitled to a per diem allowance after that 90-day period until the first day after a 03 bill that fully funds an operating budget is passed by the legislature or the first 04 day of the next regular legislative session, whichever occurs earlier. In this 05 subsection, "passed by the legislature" has the meaning given in AS 01.10.070. 06 * Sec. 3. AS 24.10.130(c) is amended to read: 07 (c) The Alaska Legislative Council shall adopt a policy in accordance with (b) 08 of this section and AS 39.23.540(d) regarding reimbursement for moving expenses 09 [APPLICABLE TO ALL LEGISLATORS] and payment of a [AN APPLICABLE] 10 per diem allowance [POLICY]. The policy shall be applicable to all members of the 11 legislature equally and must set conditions for the reimbursement for moving 12 expenses and payment of per diem and prescribe the amounts of reimbursement 13 adapted to the special needs of the legislative branch as determined by the council. 14 * Sec. 4. AS 39.23.540(d) is amended to read: 15 (d) The commission shall make available to the governor and presiding 16 officers of each house of the legislature a final report of its findings and 17 recommendations as to the rate and form of compensation, benefits, and allowances 18 for legislators, the governor, the lieutenant governor, and each principal executive 19 department head during the first 10 days of a legislative session. Subject to 20 AS 24.10.100(b), 24.10.130(b), and (g) of this section, and unless a bill disapproving 21 all the recommendations for all officers listed in this section is enacted into law within 22 60 days after the recommendations are submitted to the governor and presiding 23 officers of each house of the legislature, a recommendation as to the compensation, 24 benefits, and allowances for 25 (1) a legislator has the force of law and becomes effective on the first 26 day of the next regular legislative session; and 27 (2) the governor, the lieutenant governor, and each principal executive 28 department head has the force of law and becomes effective on the first day of the 29 fiscal year following the fiscal year in which the recommendation is submitted.
