00 HOUSE BILL NO. 225 01 "An Act relating to requirements for persons holding drivers' licenses for less than one 02 year; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 28.15 is amended by adding a new section to read: 05 Sec. 28.15.058. New driver sticker. (a) A person issued a driver's license who 06 has not been previously issued a driver's license in this state or another jurisdiction 07 shall display for one year in each motor vehicle operated by the person a moveable 08 sticker issued by the department that identifies that the vehicle is operated by a new 09 driver. The department shall notify a new driver of the sticker requirement at the time 10 of issuance of the driver's license and designate on the license that the person is a new 11 driver. The department may charge a fee for the issuance of a sticker. The sticker shall 12 be displayed in the rear window of the vehicle, or in a location specified by the 13 department if the department has adopted a regulation specifying a different location 14 for display of the sticker. The department may by regulation exempt the operation of

01 certain types of motor vehicles from the requirement to display a sticker under this 02 subsection. Failure to display a sticker as required by this subsection is an infraction 03 and may be punished by a fine of not more than $200. However, a person charged 04 with violating this subsection may not be convicted if the person 05 (1) has not previously been arrested, charged, or cited for a violation of 06 this subsection; and 07 (2) produces in court proof that the person has obtained and affixed the 08 sticker required by this subsection. 09 (b) Notwithstanding any other provision of law, a peace officer may not stop 10 or detain a motor vehicle to determine compliance with (a) of this section, or issue a 11 citation for a violation of (a) of this section, unless the peace officer has probable 12 cause to stop or detain the motor vehicle other than for a violation of (a) of this 13 section. 14 (c) The requirements of (a) of this section do not apply to a person holding a 15 driver's license 16 (1) issued to the person to operate a motor vehicle in an area of the 17 state off the road system when the person is operating a motor vehicle in that area; and 18 (2) when the person is operating a motor vehicle in a municipality with 19 a population of less than 500. 20 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 21 read: 22 APPLICABILITY. The requirements of AS 28.15.058, added by sec. 1 of this Act, 23 apply to persons issued driver's licenses on or after January 1, 2017, who have not been 24 previously issued a driver's license in this state or another jurisdiction. 25 * Sec. 3. This Act takes effect January 1, 2017.
