01 "An Act relating to king salmon tags and king salmon tag designs."                                                      
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 16.05 is amended by adding a new section to read:                                                  
04            Sec. 16.05.828. King salmon tag program. (a) The department shall annually                                 
05       produce the anadromous king salmon tag authorized in AS 16.05.340(a)(23) and (24)                                 
06       in stamp form and in quantities the commissioner considers appropriate. The                                       
07       department shall make stamps available for the creation of king salmon limited edition                            
08       prints and provide for the sale of stamps and prints to the public.                                               
09            (b)  Subject to (d) of this section, the department shall adopt an appropriate                               
10       procedure for selecting the design of the annual king salmon stamp and for the                                    
11       production and sale of the stamps. The department may only consider designs                                       
12       submitted by state residents.                                                                                     
13            (c)  The department may contract with a person to perform the department's                                   
14       responsibilities under this section. A contract under this subsection is governed by                              
15       AS 36.30 (State Procurement Code), except that a contract may include provisions for                              

01       advance payment or reimbursement for services performed under the contract. All                                   
02       costs incurred under this section may be paid from the fish and game fund. Subject to                             
03       legislative appropriation, proceeds of the sale of stamps and prints under this section                           
04       may be deposited into the fish and game fund established under AS 16.05.100.                                      
05            (d)  The person submitting the design selected under (b) of this section shall                               
06       consent to a licensing agreement, which provides                                                                  
07                 (1)  a term not to exceed two years;                                                                    
08                 (2)  a license for the department or a contractor under (c) of this section                             
09       to                                                                                                                
10                      (A)  use and reproduce the design in mediums, sizes, quantities,                                   
11            and places of the department's choice; and                                                                   
12                      (B)  sell stamps and prints featuring the design; and                                              
13                 (3)  that the original design is the property of the person submitting it.
