01 "An Act relating to the purchase of durable medical equipment under Medicaid; and                                       
02 providing for an effective date."                                                                                       
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 47.07.030 is amended by adding a new subsection to read:                                           
05            (g)  When the department authorizes the purchase of durable medical                                          
06       equipment under this section, the department may require a recipient of medical                                   
07       assistance services to purchase used or refurbished durable medical equipment if used                             
08       or refurbished durable medical equipment                                                                          
09                 (1)  is available;                                                                                      
10                 (2)  is less expensive, including shipping, than new durable medical                                    
11       equipment of the same type;                                                                                       
12                 (3)  is able to withstand at least three years of use; and                                              
13                 (4)  equally meets the needs of the recipient.                                                          
14    * Sec. 2. AS 47.07.900 is amended by adding a new paragraph to read:                                               

01                 (20)  "durable medical equipment" means equipment that                                                  
02                      (A)  can withstand repeated use;                                                                   
03                      (B)  is primarily and customarily used to serve a medical                                          
04            purpose;                                                                                                     
05                      (C)  generally is not useful to an individual in the absence of an                                 
06            illness or injury; and                                                                                       
07                      (D)  is appropriate for use in the home, school, or community.                                     
08    * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
