00 CS FOR SENATE BILL NO. 28(RES) 01 "An Act relating to the sale of timber on state land; establishing the Susitna State 02 Forest; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 38.05.110 is amended by adding a new subsection to read: 05 (c) If a sale of timber may be offered under multiple provisions of 06 AS 38.05.110 - 38.05.123, the commissioner shall determine under which of the 07 applicable provisions to offer the timber, consistent with the best interests of the state. 08 * Sec. 2. AS 38.05.118(a) is amended to read: 09 (a) Notwithstanding AS 38.05.115 and 38.05.120, and upon a finding that 10 the sale is in the best interests of the state [ANY OTHER PROVISION OF 11 AS 38.05.110 - 38.05.120], the commissioner may negotiate a sale of timber to a local 12 manufacturer of wood products or a user of wood fiber at appraised value. The 13 period of a contract for a sale of timber negotiated under this section may not exceed 14 25 years. The contract shall provide that the appraised value of timber remaining to be
01 harvested under the provisions of the contract shall be redetermined at least once every 02 five years. 03 * Sec. 3. AS 41.17 is amended by adding a new section to article 6 to read: 04 Sec. 41.17.600. Susitna State Forest. (a) Subject to valid existing rights, the 05 state-owned or acquired land and water lying within the parcels described in (e) of this 06 section is designated as the Susitna State Forest. 07 (b) The commissioner shall prepare a management plan for the Susitna State 08 Forest under AS 41.17.230. 09 (c) The commissioner may establish transportation corridors within the 10 Susitna State Forest and shall develop and maintain access for timber management and 11 multiple uses, consistent with this chapter.
