00 HOUSE BILL NO. 381 01 "An Act relating to the crime of unlawful evasion." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 11.56.335(a) is amended to read: 04 (a) A person commits the crime of unlawful evasion in the first degree if, 05 while charged with or convicted of a felony, 06 (1) the person fails to return to official detention within the time 07 authorized following temporary leave granted for a specific purpose or limited period, 08 including leave granted under AS 33.30.181; [OR] 09 (2) while on furlough under AS 33.30.101 - 33.30.131, the person fails 10 to return to the place of confinement or residence within the time authorized by those 11 having direct supervision over the person; or 12 (3) while assigned to a treatment or residential facility as a 13 condition of probation or parole 14 (A) the person fails to return to the facility within the time 15 authorized by those having direct supervision over the person;

01 (B) the person leaves the facility without permission of 02 those having direct supervision over the person; or 03 (C) the person is in transit to or from the facility, and the 04 person leaves the conveyance without the permission of those having 05 direct supervision over the person. 06 * Sec. 2. AS 11.56.340(a) is amended to read: 07 (a) A person commits the crime of unlawful evasion in the second degree if, 08 while charged with or convicted of a misdemeanor, 09 (1) the person fails to return to official detention within the time 10 authorized following temporary leave granted for a specific purpose or limited period, 11 including leave granted under AS 33.30.181; [OR] 12 (2) while on furlough under AS 33.30.101 - 33.30.131, the person fails 13 to return to the place of confinement or residence within the time authorized by those 14 having direct supervision over the person; or 15 (3) while assigned to a treatment or residential facility as a 16 condition of probation or parole, 17 (A) the person fails to return to the facility within the time 18 authorized by those having direct supervision over the person; 19 (B) the person leaves the facility without permission of 20 those having direct supervision over the person; or 21 (C) the person is in transit to or from the facility, and the 22 person leaves the conveyance without the permission of those having 23 direct supervision over the person. 24 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 25 read: 26 APPLICABILITY. This Act applies to offenses occurring on or after the effective date 27 of this Act.
