00 HOUSE BILL NO. 309 01 "An Act relating to a craft distillery license." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 04.11.080 is amended by adding a new paragraph to read: 04 (23) craft distillery license. 05 * Sec. 2. AS 04.11 is amended by adding a new section to read: 06 Sec. 04.11.175. Craft distillery license. (a) A craft distillery license authorizes 07 the holder to operate a distillery where alcoholic beverages are distilled and bottled or 08 barreled for sale. 09 (b) The holder of a craft distillery license may sell alcoholic beverages 10 distilled and bottled or barreled on the premises in quantities of 11 (1) not more than one gallon in a day to an individual present on the 12 licensed premises for consumption off the licensed premises; 13 (2) not more than five gallons in a day to a person licensed under this 14 title or located in another state or country. 15 (c) The holder of a craft distillery license may give a tour of the distillery

01 premises. 02 (d) The holder of a craft distillery license may permit a person to sample up to 03 three ounces total a day of the alcoholic beverage or beverages distilled and bottled or 04 barreled on the premises unless prohibited by AS 04.16.030. 05 (e) The biennial craft distillery license fee is $500. 06 * Sec. 3. AS 04.21.025(a) is amended to read: 07 (a) As a condition of issuance or renewal of a license and selling alcoholic 08 beverages under a license, the board shall require a licensee who sells or serves 09 alcoholic beverages and a licensee's agents and employees who sell or serve alcoholic 10 beverages or check the identification of a patron to complete an alcohol server 11 education course approved by the board, if the license is for a 12 (1) beverage dispensary; 13 (2) restaurant or eating place; 14 (3) club; 15 (4) package store; 16 (5) recreational site; 17 (6) pub; 18 (7) conditional contractor; 19 (8) a craft distillery conducting activities under AS 04.11.175. 20 * Sec. 4. AS 04.21.065(a) is amended to read: 21 (a) A holder of one of the following types of licenses or permits shall post on 22 the licensed or designated premises three separate warning signs as described in (b) of 23 this section: 24 (1) beverage dispensary license; 25 (2) restaurant or eating place license; 26 (3) club license; 27 (4) brewery license; this paragraph applies only to a brewery that 28 permits a person to sample portions of the brewery's product; 29 (5) package store license; 30 (6) common carrier dispensary license; 31 (7) recreational site license;

01 (8) pub license; 02 (9) winery license; this paragraph applies only to a winery that permits 03 a person to sample portions of the winery's product; 04 (10) caterer's permit; 05 (11) special events permit; 06 (12) conditional contractor's permit; 07 (13) another license or permit issued by the board authorizing 08 consumption of alcoholic beverages; 09 (14) craft distillery license; this paragraph applies only to a craft 10 distillery that permits a person to sample portions of the craft distillery's 11 product.
