00 CS FOR HOUSE BILL NO. 134(HSS) 01 "An Act requiring Medicaid payment for medication compliance packaging, delivery, 02 and dispensing services of a prescription for specified recipients; and providing for an 03 effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 47.07 is amended by adding a new section to read: 06 Sec. 47.07.031. Scheduled units of use prescription drug dispensing 07 services. (a) In addition to the services provided for under AS 47.07.030, the 08 department shall establish a fee to be added to a dispensing fee to pay a qualified 09 pharmacy for dispensing services for a prescription that requires scheduled units of 10 use in medication compliance packaging for the purpose of assisting a qualified 11 medical assistance recipient under (c) of this section to adhere to a specific dosing 12 regimen. 13 (b) A pharmacy is qualified to dispense a prescription in medication 14 compliance packaging for payment under this section if the pharmacy is a provider of

01 services under the medical assistance program established under this chapter and 02 provides dispensing services to a qualified medical assistance recipient as follows: 03 (1) consolidating prescriptions for purposes of reporting to the 04 prescriber on prescription compliance; 05 (2) creating medication compliance packaging for the interval 06 specified on the prescription, using trained personnel; 07 (3) offering quarterly review with a recipient or the recipient's 08 representative of a recipient's complete medication profile and medication 09 administration record, including review of compliance; 10 (4) reporting to the prescriber patient compliance, polypharmacy, or 11 other issues related to the recipient's medication at least quarterly; and 12 (5) delivering prescriptions using the most cost-effective method. 13 (c) A medical assistance recipient is qualified to receive a prescription in 14 medication compliance packaging under (a) of this section if the recipient is a person 15 who is eligible for medical assistance under AS 47.07 and is 16 (1) residing in a congregate living home, as defined by the department; 17 (2) receiving community-based waiver services; 18 (3) disabled or blind; 19 (4) an adult with a serious mental illness, as defined by the department; 20 or 21 (5) a child experiencing a severe emotional disturbance, as defined by 22 the department. 23 (d) In this section, 24 (1) "medication compliance packaging" means a package containing a 25 specified quantity of one or more prescription medications that have been divided by a 26 provider into units of use to be taken over a specified period according to a 27 prescription issued by an authorized health care provider and that requires specialized 28 dispensing services; 29 (2) "units of use" means a prescription medication packaged in a way 30 that is designed to simplify a medication regimen to improve adherence to a daily 31 therapeutic schedule.

01 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 02 read: 03 APPROVAL; CONTINGENT EFFECT; NOTICE. (a) The commissioner of health 04 and social services shall request the approval of the United States Department of Health and 05 Human Services for implementation of AS 47.07.031, added by sec. 1 of this Act. 06 (b) AS 47.07.031, added by sec. 1 of this Act, takes effect only if, and only to the 07 extent that, implementation of AS 47.07.031 is approved by the United States Department of 08 Health and Human Services. 09 (c) The commissioner of health and social services shall notify the revisor of statutes 10 when the United States Department of Health and Human Services approves implementation 11 of AS 47.07.031. 12 * Sec. 3. If AS 47.07.031, added by sec. 1 of this Act, takes effect, it takes effect on the date 13 that the revisor of statutes receives notice from the commissioner of health and social services 14 that the United States Department of Health and Human Services has approved 15 implementation of that section.
