01 "An Act relating to the governing board and duties of the special education service                                     
02 agency; relating to allocations to the special education service agency; extending the                                  
03 special education service agency; and providing for an effective date."                                                 
04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
05    * Section 1. AS 14.30.610 is amended to read:                                                                      
06            Sec. 14.30.610. Governing agency [BOARD]. The agency shall be governed                                 
07       by the department [GOVERNOR'S COUNCIL ON DISABILITIES AND SPECIAL                                             
08       EDUCATION (AS 47.80.030)].                                                                                      
09    * Sec. 2. AS 14.30.650 is amended to read:                                                                         
10            Sec. 14.30.650. Funding. Each fiscal year the department shall allocate to the                             
11       agency not less than $15.75 times the number of students in the state in average daily                            
12       membership in the preceding fiscal year as determined under AS 14.17.600. Money to                                
13       carry out the provisions of this section may be appropriated annually by the                                      
14       legislature. If amounts are insufficient to meet the allocation authorized under this                             

01       section for a fiscal year, the allocation shall be reduced pro rata. [THE AMOUNT                                  
02       ALLOCATED TO THE AGENCY SHALL BE REDUCED EACH FISCAL YEAR                                                         
03       BY THE AMOUNT CONTRIBUTED BY THE DEPARTMENT TO THE                                                                
04       TEACHERS' RETIREMENT SYSTEM (AS 14.25) OR THE PUBLIC EMPLOYEES'                                                   
05       RETIREMENT SYSTEM (AS 39.35) ON BEHALF OF EMPLOYEES OF THE                                                        
06       AGENCY.]                                                                                                        
07    * Sec. 3. AS 44.66.010(6) is amended to read:                                                                      
08                 (6)  special education service agency (AS 14.30.600) - June 30, 2021                                
09       [2013];                                                                                                           
10    * Sec. 4. AS 47.80.090(12) is repealed.                                                                          
11    * Sec. 5. The uncodified law of the State of Alaska is amended by adding a new section to                          
12 read:                                                                                                                   
13       RETROACTIVITY. Section 3 of this Act is retroactive to June 30, 2013.                                           
14    * Sec. 6. This Act takes effect immediately under AS 01.10.070(c).
