00 CS FOR SENATE BILL NO. 119(L&C) 01 "An Act relating to athletic trainers." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 08.01.010 is amended by adding a new paragraph to read: 04 (39) regulation of athletic trainers under AS 08.07. 05 * Sec. 2. AS 08 is amended by adding a new chapter to read: 06 Chapter 07. Athletic Trainers. 07 Sec. 08.07.010. License required. (a) An individual may not practice or offer 08 to practice athletic training, or allow another person to offer athletic training by the 09 individual, in the state without being licensed under this chapter, unless the individual 10 (1) is a student in an accredited athletic trainer program; 11 (2) is present in the state for not more than 90 days for a specific 12 athletic event or series of athletic events with an individual or group not based in the 13 state; or 14 (3) is authorized to practice athletic training under another provision of 15 Alaska law.

01 (b) This section does not prohibit a person licensed under another chapter of 02 this title from performing functions defined as athletic training if those functions are 03 within the scope of that person's license and the person does not use a title listed in (c) 04 of this section. 05 (c) Unless licensed under this chapter, an individual may not use the titles 06 "athletic trainer," "licensed athletic trainer," "A.T.," or any combination of those terms 07 to indicate that the individual is a licensed athletic trainer. 08 Sec. 08.07.020. Qualifications for license; fee; renewal. (a) The department 09 shall issue an athletic trainer license to an individual who 10 (1) applies to the department on a form provided by the department; 11 (2) pays the fees established by the department; and 12 (3) provides proof of certification by the National Athletic Trainers' 13 Association Board of Certification, Inc. 14 (b) An athletic trainer license may be renewed on proof of certification by the 15 National Athletic Trainers' Association Board of Certification, Inc., and as provided in 16 AS 08.01.100. 17 Sec. 08.07.030. Definition. In this chapter, "athletic training" means the 18 treatment of an individual under the direction of a physician licensed under AS 08.64 19 to manage risk of injury and prevent injury, evaluate clinically, assess, and treat an 20 individual's injury or illness, and rehabilitate and recondition that individual. 21 * Sec. 3. AS 09.65.300(c) is amended to read: 22 (c) In this section, 23 (1) "health care provider" means a state licensed physician, physician 24 assistant, dentist, dental hygienist, osteopath, optometrist, chiropractor, registered 25 nurse, practical nurse, nurse midwife, advanced nurse practitioner, naturopath, 26 physical therapist, occupational therapist, marital and family therapist, psychologist, 27 psychological associate, licensed clinical social worker, athletic trainer, or certified 28 direct-entry midwife; 29 (2) "health care services" means services received by an individual in 30 order to treat or to prevent illness or injury; 31 (3) "nonprofit organization" means an organization that qualifies for

01 exemption from taxation under 26 U.S.C. 501(c)(3) or (4) (Internal Revenue Code).
