00 SENATE BILL NO. 44 01 "An Act relating to the Southeast State Forest; and providing for an effective date." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 41.17.500(a) is amended to read: 04 (a) Subject to valid existing rights, the state-owned or acquired land and water 05 lying within the parcels described in (d) and (f) of this section is designated as the 06 Southeast State Forest. 07 * Sec. 2. AS 41.17.500(e) is amended to read: 08 (e) Nothing in this section prevents the City and Borough of Wrangell from 09 exercising its land selection rights under AS 29.65.040(d) to state land within its 10 boundaries. If new municipalities are incorporated before June 30, 2019, and lands 11 designated in (d) and (f) of this section are within their boundaries, those lands that 12 were classified as vacant, unappropriated, unreserved state land before establishment 13 of the Southeast State Forest shall be used to calculate the municipal entitlement 14 acreage under AS 29.65.030 but may not be selected. 15 * Sec. 3. AS 41.17.500 is amended by adding a new subsection to read:

The uncodified law of the State of Alaska is amended by adding a new section to 09 read: 10 TRANSITION: REGULATIONS. The Department of Natural Resources may 11 immediately adopt regulations necessary to implement the changes made by this Act. The 12 regulations take effect under AS 44.62 (Administrative Procedure Act), but not before July 1, 13 2011. 14 * Sec. 5. Section 4 of this Act takes effect immediately under AS 01.10.070(c). 15 * Sec. 6. Except as provided in sec. 5 of this Act, this Act takes effect July 1, 2011.
