00 HOUSE BILL NO. 282 01 "An Act relating to applying military education, training, and service credit to 02 occupational licensing and certain postsecondary education and employment training 03 requirements; and providing for a temporary occupational license for qualified military 04 service members." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. AS 08.01 is amended by adding a new section to read: 07 Sec. 08.01.064. Military education, training, and service credit; temporary 08 license. (a) Notwithstanding another provision of law, the department or applicable 09 board shall accept relevant military education, training, and service as equivalent to 10 some or all of the qualifications otherwise required of an applicant for a license or 11 certificate issued under this chapter if the applicant provides satisfactory evidence of 12 successful completion of the education, training, or service as a member of the armed 13 forces of the United States, the United States Reserves, the National Guard of any 14 state, the Military Reserves of any state, or the Naval Militia of any state.

01 (b) Notwithstanding another provision of law, the department or applicable 02 board shall issue a license or certificate to a person who 03 (1) applies to the department or relevant board in a manner prescribed 04 by the department or board; 05 (2) if required by the department or appropriate board for obtaining a 06 license in the applicant's profession, has been fingerprinted and has provided the fees 07 required by the Department of Public Safety under AS 12.62.160 for criminal justice 08 information and a national criminal history record check; the fingerprints and fees 09 shall be forwarded to the Department of Public Safety to obtain a report of criminal 10 justice information under AS 12.62 and a national criminal history record check under 11 AS 12.62.400; 12 (3) has not committed an act in any jurisdiction that would have 13 constituted grounds for the refusal, suspension, or revocation of a license or certificate 14 to practice that occupation under this title at the time the act was committed; 15 (4) has not been disciplined by a licensing or credentialing entity in 16 any jurisdiction and is not the subject of an unresolved complaint, review procedure, 17 or disciplinary proceeding conducted by a licensing or credentialing entity in any 18 jurisdiction; 19 (5) pays any fees required under this title; and 20 (6) while on active duty in the armed forces of the United States or any 21 state, as described in (a) of this section, 22 (A) held a current license or certificate in another state, district, 23 or territory of the United States and has practiced in the area of the license; or 24 (B) met standards for an equivalent license or a certificate of 25 technical training established by a branch of the armed forces of the United 26 States or any state, as described in (a) of this section. 27 (c) The department or applicable board shall expedite the procedure for 28 issuance of a license or certificate under (b) of this section. 29 (d) A license or certificate issued under (b) of this section is valid for 180 days 30 and may be extended at the discretion of the department or applicable board for one 31 additional 180-day period if the license holder applies for an extension on a form

01 approved by the department or applicable board. 02 (e) The department or applicable board may adopt regulations necessary to 03 implement this section. 04 * Sec. 2. AS 14.40.210 is amended by adding a new subsection to read: 05 (c) The president of the University of Alaska shall implement a policy and 06 procedure for the acceptance of academic credit toward a degree or technical program 07 offered by the university if an applicant provides satisfactory evidence of successful 08 completion of relevant military education, training, or service as a member of the 09 armed forces of the United States, the United States Reserves, the National Guard of 10 any state, the Military Reserves of any state, or the Naval Militia of any state. 11 * Sec. 3. AS 14.48.060 is amended by adding a new subsection to read: 12 (d) In addition to the minimum standards established under (b) of this section, 13 the commission shall develop and implement policies and procedures that require a 14 postsecondary educational institution to provide credit toward a degree or program for 15 a person enrolled in the postsecondary educational institution if the person provides 16 satisfactory evidence of successful completion of relevant military education, training, 17 or service as a member of the armed forces of the United States, the United States 18 Reserves, the National Guard of any state, the Military Reserves of any state, or the 19 Naval Militia of any state. 20 * Sec. 4. AS 23.15.820(a) is amended to read: 21 (a) The Alaska Workforce Investment Board shall 22 (1) administer the Alaska technical and vocational education program 23 established in AS 23.15.820 - 23.15.850; 24 (2) facilitate the development of a statewide policy for a coordinated 25 and effective technical and vocational education training system in this state and, to 26 the extent authorized by federal and state law, plan and coordinate federal, state, and 27 local efforts in technical and vocational education programs; 28 (3) adopt regulations under AS 44.62 (Administrative Procedure Act) 29 to carry out the purposes of AS 23.15.820 - 23.15.850, including regulations that set 30 standards for the percentage of a grant that may be used for administrative costs; the 31 regulations must clearly identify and distinguish between expenses that may be

01 included in administrative costs and those that may not be included in administrative 02 costs; the percentage allowed for administrative costs may not exceed the lesser of five 03 percent or the amount permitted under the requirements of a federal program, if 04 applicable; 05 (4) administer the grant program under AS 23.15.840 and establish 06 grant administration requirements including accounting procedures that apply to 07 qualified entities and their grantees; 08 (5) facilitate the development and implementation of a statewide 09 policy and procedure that provides for the acceptance of credit toward a degree 10 or technical program offered by a vocational or technical training center in the 11 state for an applicant who provides satisfactory evidence of successful completion 12 of relevant military education, training, or service as a member of the armed 13 forces of the United States, the United States Reserves, the National Guard of any 14 state, the Military Reserves of any state, or the Naval Militia of any state.
