00 HOUSE BILL NO. 262 01 "An Act relating to the offense of interference with access to public buildings or 02 transportation facilities, when a person conditions access to a public building or 03 transportation facility on consent to certain physical contact or to an electronic process 04 that produces a picture of the private exposure of the person." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. AS 11.76 is amended by adding a new section to read: 07 Sec. 11.76.118. Interference with access to public buildings or 08 transportation facilities. (a) A person commits the offense of interference with 09 access to public buildings or transportation facilities if the person, as a condition for 10 access to a public building or transportation facility, requires another person to consent 11 or otherwise submit to 12 (1) physical contact by any person touching directly or through 13 clothing the genitals, buttocks, or female breast of the person seeking access; or 14 (2) any electronic process that produces an electronic image of the

01 genitals, anus, or female breast or otherwise creates an electronic image of the person 02 seeking access that exposes or reveals a physical characteristic that is normally hidden 03 by clothing and is not normally visible to the public. 04 (b) The defense of justification provided in AS 11.81.420 is not available in a 05 prosecution under this section. 06 (c) In this section, "public building" does not include a correctional facility or 07 probation office, a restricted access area of a law enforcement building or federal 08 building, a courtroom, offices of the Alaska Court System, or a courthouse that is 09 occupied only by the Alaska Court System and other justice agencies. 10 (d) Interference with access to public buildings or transportation facilities is a 11 class A misdemeanor.
