00 CS FOR HOUSE BILL NO. 245(FIN) 01 "An Act establishing a snow classic as an authorized form of charitable gaming; and 02 relating to the use of broadcasting and the Internet to promote a raffle and lottery." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 05.15.100(a) is amended to read: 05 (a) The department may issue a permit to a municipality or qualified 06 organization. The permit gives the municipality or qualified organization the privilege 07 of conducting bingo, raffles and lotteries, pull-tab games, ice classics, race classics, 08 rain classics, goose classics, mercury classics, deep freeze classics, canned salmon 09 classics, salmon classics, king salmon classics, dog mushers' contests, snow classics, 10 snow machine classics, fish derbies, animal classics, crane classics, cabbage classics, 11 Calcutta pools, and contests of skill. 12 * Sec. 2. AS 05.15.115(c) is amended to read: 13 (c) A permittee may not contract with more than one operator at a time to 14 conduct the same type of activity. For the purposes of this subsection, bingo games,
01 raffles, lotteries, pull-tab games, ice classics, race classics, rain classics, goose 02 classics, mercury classics, deep freeze classics, canned salmon classics, salmon 03 classics, king salmon classics, dog mushers' contests, snow classics, snow machine 04 classics, fish derbies, animal classics, crane classics, cabbage classics, and contests of 05 skill are each a different type of activity. 06 * Sec. 3. AS 05.15.180(b) is amended to read: 07 (b) With the exception of raffles, lotteries, bingo games, pull-tab games, race 08 classics, rain classics, goose classics, mercury classics, deep freeze classics, dog 09 mushers' contests, snow classics, snow machine classics, canned salmon classics, 10 salmon classics, animal classics, crane classics, cabbage classics, Calcutta pools, and 11 king salmon classics, an activity may not be licensed under this chapter unless it 12 existed in the state in substantially the same form and was conducted in substantially 13 the same manner before January 1, 1959. A snow machine classic may not be licensed 14 under this chapter unless it has been in existence for at least five years before the 15 licensing. An animal classic may not be licensed under this chapter unless it was in 16 existence before November 1, 2002. 17 * Sec. 4. AS 05.15.640(a) is amended to read: 18 (a) A person may not use broadcasting to promote or conduct a charitable 19 gaming activity under this chapter except that a person may use 20 (1) broadcasting to promote a fish derby, a dog mushers' contest, [OR] 21 a type of classic defined in AS 05.15.690, or [(2) RADIO OR TELEVISION 22 BROADCASTING TO PROMOTE] a [CHARITABLE] raffle and lottery; or 23 (2) the Internet or an Internet communication to promote a 24 charitable gaming activity under this chapter [IN THIS SUBSECTION, 25 "BROADCASTING" INCLUDES TELEVISION AND RADIO TRANSMISSION 26 BY 2,500 MEGAHERTZ, MICROWAVE VIDEO AND AUDIO PROGRAMMING, 27 SLOW-SCAN TELEVISION PROGRAMMING, AND PROGRAMMING BY WAY 28 OF SATELLITE, CABLE, TELETYPE, OR FACSIMILE TRANSMISSION AND 29 DISTRIBUTION METHODS; "RAFFLE AND LOTTERY" HAS THE MEANING 30 GIVEN IN AS 05.15.690]. 31 * Sec. 5. AS 05.15.640 is amended by adding a new subsection to read:
01 (c) In this section, 02 (1) "broadcasting" includes television and radio transmission by 2,500 03 megahertz, microwave video and audio programming, slow-scan television 04 programming, and programming by way of satellite, cable, teletype, or facsimile 05 transmission and distribution methods; 06 (2) "Internet" means the combination of computer systems or networks 07 that make up the international network for interactive communications services, 08 including remote logins, file transfer, electronic mail, and newsgroups; 09 (3) "Internet communication" means an announcement or 10 advertisement disseminated through the Internet. 11 * Sec. 6. AS 05.15.690 is amended by adding a new paragraph to read: 12 (49) "snow classic" means a game of chance in which a prize of money 13 is awarded to the closest guess of the total snow accumulation on the ground at a 14 specific location on Mount Alyeska on a specific date and time and is limited to the 15 Alyeska Snow Classic operated and administered by Four Valleys Community School, 16 Inc. 17 * Sec. 7. 15 AAC 160.945(b) is annulled.
