01 "An Act relating to requirements for persons holding provisional drivers' licenses."                                    
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 28.15.055 is amended by adding new subsections to read:                                            
04            (b)  A person holding a provisional driver's license shall display in the rear                               
05       window of each vehicle operated by the person a sticker issued by the department that                             
06       identifies that the vehicle is operated by a provisional licensee. The department may                             
07       charge a fee for the issuance of a sticker. Failure to display a sticker as required by this                      
08       subsection is an infraction and may be punished by a fine of not more than $300.                                  
09       However, a person charged with violating this section may not be convicted if the                                 
10       person                                                                                                            
11                 (1)  has not previously been arrested, charged, or cited for a violation of                             
12       this section; and                                                                                                 
13                 (2)  produces in court proof that the person has obtained and affixed the                               
14       sticker required by this subsection.                                                                              
15            (c)  Notwithstanding any other provision of law, a peace officer may not stop                                

01       or detain a motor vehicle to determine compliance with (b) of this section, or issue a                            
02       citation for a violation of (b) of this section, unless the peace officer has probable                            
03       cause to stop or detain the motor vehicle other than for a violation of (b) of this                               
04       section.
