AS 23.30.097(a) is amended to read: 05 (a) All fees and other charges for medical treatment or service are subject to 06 regulation by the board consistent with this section. A fee or other charge for medical 07 treatment or service may not exceed the lowest of 08 (1) the usual, customary, and reasonable fees for the treatment or 09 service in the community in which it is rendered, for treatment or service provided on 10 or after December 31, 2010, not to exceed the fees or other charges as specified in 11 a fee schedule established by the board and adopted by reference in regulation; 12 the fee schedule must be based on statistically credible data, including charges 13 for the most recent category I, II, and III medical services maintained by the 14 American Medical Association and the Health Care Procedure Coding System

01 for medical supplies, injections, emergency transportation, and other medically 02 related services, and must result in a schedule that 03 (A) reflects the cost in the geographical area where services 04 are provided; and 05 (B) is at the 90th percentile [(A) PROVIDED BEFORE 06 AUGUST 1, 2007, NOT TO EXCEED THE FEES IN THE BOARD'S FEE 07 SCHEDULE DATED DECEMBER 1, 2004; 08 (B) PROVIDED ON OR AFTER AUGUST 1, 2007, BUT 09 BEFORE MARCH 31, 2009, NOT TO EXCEED THE FEES OTHERWISE 10 APPLICABLE IN (A) OF THIS PARAGRAPH ADJUSTED BY THE 11 PERCENTAGE CHANGE FROM 2004 TO 2006 IN THE MEDICAL CARE 12 COMPONENT OF THE CONSUMER PRICE INDEX FOR ALL URBAN 13 CONSUMERS COMPILED BY THE UNITED STATES DEPARTMENT OF 14 LABOR, BUREAU OF LABOR STATISTICS; 15 (C) PROVIDED ON OR AFTER MARCH 31, 2009, BUT 16 BEFORE DECEMBER 31, 2010, NOT TO EXCEED THE FEES 17 OTHERWISE APPLICABLE IN (A) OF THIS PARAGRAPH ADJUSTED 18 BY THE PERCENTAGE CHANGE FROM 2004 TO 2008 IN THE 19 MEDICAL CARE COMPONENT OF THE CONSUMER PRICE INDEX 20 FOR ALL URBAN CONSUMERS COMPILED BY THE UNITED STATES 21 DEPARTMENT OF LABOR, BUREAU OF LABOR STATISTICS]; 22 (2) the fee or charge for the treatment or service when provided to the 23 general public; or 24 (3) the fee or charge for the treatment or service negotiated by the 25 provider and the employer under (c) of this section. 26 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
