00Enrolled SB 261 01 Relating to the membership of the Alcoholic Beverage Control Board; and providing for an 02 effective date. 03 _______________ 04 * Section 1. AS 04.06.020 is amended to read: 05 Sec. 04.06.020. Appointment and qualifications. The board consists of five 06 members appointed by the governor and confirmed by a majority of the members of 07 the legislature in joint session. A member of the board may not hold any other state or 08 federal office, either elective or appointive. Two members of the board shall be 09 persons actively engaged in the alcoholic beverage industry, except that no member 10 may hold a wholesale license or be an officer, agent, or employee of a wholesale 11 alcoholic beverage enterprise. Not more than two [NO THREE] members of the 12 board may be engaged in the same business, occupation, or profession. Three [AT 13 LEAST THREE] members of the board, at least one of whom shall reside in a rural 14 area, shall represent the general public. A board member representing the general

01 public or an immediate family member of a board member representing the general 02 public may not have any financial interest in the alcoholic beverage industry. In this 03 section, 04 (1) "immediate family member" means a spouse, child, or parent; 05 (2) "rural area" means a community that is not connected by road 06 or rail to Anchorage or Fairbanks, that has a population of 6,000 or less or that 07 has a population of more than 6,000 and has participated in a local option 08 election under AS 04.11.491, and that is 09 (A) a city; for purposes of this subparagraph, "city" has the 10 meaning given in AS 29.71.800; or 11 (B) an established village that is located in a borough or in 12 the unorganized borough. 13 * Sec. 2. AS 04.06.020 is amended by adding a new subsection to read: 14 (b) For purposes of (a)(2) of this section, the population of a community is the 15 population of that community as determined under AS 29.60.860(c). 16 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 17 read: 18 TRANSITION. The requirement that at least one member of the Alcoholic Beverage 19 Control Board be a resident of a rural area added in AS 04.06.020, as amended by secs. 1 and 20 2 of this Act, first applies on the date the first term of office of a board member who 21 represents the general public expires, and applies thereafter. 22 * Sec. 4. This Act takes effect immediately under AS 01.10.070(c).
