00 CS FOR SENATE BILL NO. 168(HSS) 01 "An Act relating to state certification and designation of trauma centers; creating the 02 trauma care fund to offset the cost of trauma care provided at certified and designated 03 trauma centers and including a portion of the tax levy on alcohol as a source of money 04 that may be appropriated to the trauma care fund; and providing for an effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. AS 18.08.082 is amended by adding a new subsection to read: 07 (c) The commissioner shall establish special designations in regulation for 08 varying levels of trauma care provided by a certified trauma center that shall be used 09 to set compensation eligibility and amounts under AS 18.08.085. The designations 10 shall be based on nationally recognized standards and procedures. 11 * Sec. 2. AS 18.08 is amended by adding a new section to read: 12 Sec. 18.08.085. Trauma care fund; creation. (a) The trauma care fund is 13 created. The purpose of the fund is to compensate certified trauma centers in the state 14 that receive a special designation under AS 18.08.082(c).

01 (b) The fund consists of money appropriated to it by the legislature, including 02 donations, recoveries of or reimbursements for awards made from the fund, income 03 from the fund, and other program receipts from activities under this chapter. 04 Appropriations to the fund do not lapse. 05 (c) The commissioner shall administer the fund in accordance with the 06 provisions of this chapter. The commissioner shall spend money from the trauma care 07 fund for the purpose established in (a) of this section. The commissioner may establish 08 and seek the advice of a special committee for review of statewide trauma care and 09 compensation standards. 10 (d) The commissioner may not provide more than 25 percent of the total 11 assets, including earnings, of the fund in a fiscal year to one trauma center. 12 * Sec. 3. AS 43.60 is amended by adding a new section to read: 13 Sec. 43.60.055. Disposition of proceeds; availability for appropriation to 14 the trauma care fund. The portion of the tax collected under AS 43.60.010 that is not 15 separately accounted for under AS 43.60.050(a) may be appropriated to the trauma 16 care fund (AS 18.08.085). Nothing in this section creates a dedicated fund. 17 * Sec. 4. This Act takes effect immediately under AS 01.10.070(c).
