00 SENATE BILL NO. 16 01 "An Act defining 'natural person,' 'human being,' 'child,' 'individual,' and 'born alive.'" 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section 04 to read: 05 SHORT TITLE. This Act may be known as the Born-Alive Infants Protection Act. 06 * Sec. 2. AS 01.10.060 is amended by adding a new subsection to read: 07 (c) In the laws of the state, including administrative interpretations of the laws 08 through regulation and ruling, "natural person," "human being," "child," and 09 "individual" include an infant member of the species Homo sapiens who is born alive 10 at any stage of development. Nothing in this subsection may be construed to affirm, 11 deny, expand, or contract any legal status or legal right applicable to any member of 12 the species Homo sapiens at any point before being born alive. In this subsection, 13 "born alive," with respect to a member of the species Homo sapiens, means the 14 complete expulsion or extraction from the mother of that member, at any stage of 15 development, who, after the expulsion or extraction, breathes or has a beating heart,

01 pulsation of the umbilical cord, or definite movement of voluntary muscles, regardless 02 of whether the umbilical cord has been cut, and regardless of whether the expulsion or 03 extraction occurs as a result of natural or induced labor, cesarean section, or induced 04 abortion.
