00                      HOUSE JOINT RESOLUTION NO. 23                                                                     
01 Proposing an amendment to the Constitution of the State of Alaska relating to the                                       
02 facility maintenance fund.                                                                                              
03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
04    * Section 1. Article IX, Constitution of the State of Alaska, is amended by adding a new                           
05 section to read:                                                                                                        
06            Section 18. Facility Maintenance Fund. (a) The facility maintenance fund is                                
07       established as a separate fund in the State treasury. Section 7 of this article does not                          
08       apply to appropriations made to the fund or appropriations made from the fund.                                    
09       Appropriations may be made to the principal of the fund. Money in the fund shall be                               
10       invested so as to yield income to the fund.                                                                       
11            (b)  Appropriations may not be made from the principal of the facility                                       
12       maintenance fund. Appropriations may only be made from the income of the fund for                                 
13       maintenance and upgrades of buildings, roads, and other facilities of the State, its                              
14       agencies, public corporations, school districts, or other entities, including the                                 
15       University of Alaska, or of a city or borough of the state, its agencies, public                                  
16       corporations, or other entities. Appropriations of income may not be made for                                     

01       construction of new facilities.                                                                                   
02    * Sec. 2. The amendment proposed by this resolution shall be placed before the voters of the                       
03 state at the next general election in conformity with art. XIII, sec. 1, Constitution of the State                      
04 of Alaska, and the election laws of the state.
