00 HOUSE BILL NO. 388 01 "An Act relating to registration and operation of minitrucks." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 28.05.011(a) is amended to read: 04 (a) The commissioner of public safety shall, unless otherwise provided by 05 statute, adopt regulations in compliance with AS 44.62 (Administrative Procedure 06 Act) necessary to carry out the provisions of this title and other statutes whose 07 administration is vested in the Department of Public Safety. The regulations must 08 include 09 (1) rules of the road relating to the driving, stopping, standing, parking, 10 and other conduct of vehicles, to pedestrians, and to official traffic control devices; 11 regulations adopted under this paragraph may not prohibit the use of an electric 12 personal motor vehicle on a sidewalk, bike path, or vehicular way or area restricted to 13 the use of pedestrians; limitations on regulation of electric personal motor vehicles 14 imposed under this paragraph do not apply to a municipal ordinance regulating electric 15 personal motor vehicles enacted to meet local requirements;

01 (2) minimum equipment for vehicles, including minimum standards of 02 compliance to be met by manufacturers and vehicle sales and repairs businesses; 03 (3) inspection of vehicles other than commercial motor vehicles, and 04 the removal of vehicles from areas of public use when they are found to be in a 05 defective or unsafe condition; 06 (4) abandonment of vehicles; 07 (5) management of records of the Department of Public Safety 08 required for that department's administration of this title and its regulations adopted 09 under this title, including provisions for ensuring the accuracy of information 10 contained in automated and manual information retrieval systems; 11 (6) definitions of words and phrases used in this title and in regulations 12 adopted under this title unless otherwise provided by statute; 13 (7) certification and regulation of junk yards; 14 (8) provisions that 15 (A) restrict the use of a minitruck on any highway with a 16 maximum posted speed of more than 65 miles an hour; 17 (B) prohibit a person from operating a minitruck so slowly 18 as to impede the normal and reasonable movement of traffic, except when 19 the slow speed is necessary for safe operation or for compliance with 20 statutes, regulations, or ordinances. 21 * Sec. 2. AS 28.90.990(a) is amended by adding new paragraphs to read: 22 (31) "minitruck" means a type of pick-up truck that meets weight, 23 equipment, and safety standards set by the department by regulation and that has not 24 been modified to have a maximum speed greater than 70 miles an hour; 25 (32) "pick-up truck" means a type of motor vehicle constructed with a 26 partially open body designed for the transportation of both persons and property.
