01 "An Act relating to criminal fines for organizations."                                                                  
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 12.55.035(c) is amended to read:                                                                   
04            (c)  Upon conviction of an offense, a defendant that is an organization may be                               
05       sentenced to pay a fine not exceeding the greater of                                                              
06                 (1)  an amount that is                                                                                  
07                      (A)  $1,000,000 for a felony offense or for a misdemeanor                                          
08            offense that results in death;                                                                               
09                      (B)  $200,000 for a class A misdemeanor offense that does not                                      
10            result in death;                                                                                             
11                      (C)  $25,000 for a class B misdemeanor offense that does not                                       
12            result in death;                                                                                             
13                      (D)  $10,000 for a violation;                                                                      
14                 (2)  three times the pecuniary gain                                                                     
15                      (A)  realized by the defendant as a result of the offense; or                                  

01                      (B)  sought by the defendant for the defendant or for others                                   
02            by the commission of the offense; or                                                                     
03                 (3)  three times the pecuniary damage or loss                                                           
04                      (A)  caused by the defendant to another, or to the property of                                 
05            another, as a result of the offense; or                                                                  
06                      (B)  to another or the property of another sought by the                                       
07            defendant by the commission of the offense.                                                            
08    * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to                          
09 read:                                                                                                                   
10       APPLICABILITY. The changes to AS 12.55.035(c), added by sec. 1 of this Act, apply                                 
11 to offenses occurring on or after the effective date of this Act.
