00 HOUSE BILL NO. 260 01 "An Act relating to preventive care and disease management services for medical 02 assistance recipients; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 47.07 is amended by adding a new section to read: 05 Sec. 47.07.047. Preventive care and disease management services. (a) The 06 department shall provide preventive care and disease management services under a 07 waiver in accordance with 42 U.S.C. 1396 - 1396p (Title XIX, Social Security Act), 08 this chapter, and regulations adopted under this chapter, if the department has received 09 approval from the federal government and the department has received appropriations 10 allocated for the purpose. 11 (b) The department shall establish enrollment procedures and provide services 12 under this section that enable eligible medical assistance recipients to remain in the 13 least restrictive and most home-like environment while preventing the need for acute 14 or emergency care. Services must include
01 (1) medication management; 02 (2) coordination with a primary care provider; 03 (3) use of evidence-based practice guidelines; 04 (4) patient education; 05 (5) provider collaboration; 06 (6) routine health and outcome assessments; 07 (7) other preventive and disease management services identified by the 08 department in regulation. 09 (c) The department may contract with qualified entities or providers to provide 10 preventive care and disease management services under this section. 11 (d) The department shall evaluate the projected and actual savings resulting 12 from implementation of this section and provide an annual report to the legislature 13 describing the services provided, participant outcomes, and savings. 14 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 15 read: 16 FEDERAL MEDICAL ASSISTANCE APPROVAL; NOTIFICATION. (a) The 17 Department of Health and Social Services shall apply for a waiver from the United States 18 Department of Health and Human Services to provide preventive care and disease 19 management services to medical assistance recipients under AS 47.07.047, enacted by sec. 1 20 of this Act. 21 (b) On or before July 1, 2011, the commissioner of health and social services shall 22 notify the revisor of statutes of the approval or denial of a waiver applied for under this 23 section. 24 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 25 read: 26 PREVENTIVE CARE AND DISEASE MANAGEMENT SERVICES; 27 REGULATIONS. The Department of Health and Social Services may adopt regulations 28 necessary to implement AS 47.07.047, enacted by sec. 1 of this Act. The regulations take 29 effect under AS 44.62 (Administrative Procedure Act) but not before the effective date of sec. 30 1 of this Act. 31 * Sec. 4. Sections 2 and 3 of this Act take effect immediately under AS 01.10.070(c).
