00 HOUSE BILL NO. 237 01 "An Act prohibiting certain per diem payments and delaying the payment of salaries to 02 legislators based on the failure to adopt an education operating budget before March 1 03 of each fiscal year." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 24.10.100 is amended by adding a new subsection to read: 06 (b) If the operating budget for public education grade levels K-12 for the next 07 fiscal year has not been not adopted by the legislature, beginning on March 1 payment 08 of salaries for all legislators shall be delayed. After the operating budget for public 09 education is adopted by both houses, salary payments that have been delayed under 10 this subsection shall be made to legislators as soon as feasible and other salary 11 payments shall be resumed as normally scheduled. 12 * Sec. 2. AS 24.10.130 is amended by adding a new subsection to read: 13 (d) If the operating budget for public education grade levels K-12 for the next 14 fiscal year has not been adopted by the legislature, beginning on March 1 legislators
01 are no longer entitled to per diem payments under (b) of this section. On the day after 02 the operating budget for public education is adopted by both houses, legislators may 03 again receive per diem payments as authorized under (b) of this section. However, 04 legislators may not receive per diem payments for the period beginning March 1 and 05 ending the day they may begin again to receive those payments under this subsection.
