00 HOUSE BILL NO. 183 01 "An Act relating to land management by the Board of Fisheries, Board of Game, and 02 Department of Natural Resources for sport, subsistence, and commercial fishing, sport 03 and subsistence hunting, and trapping." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 16.05 is amended by adding a new section to read: 06 Sec. 16.05.839. Fish and game land management. (a) When open and closed 07 seasons and areas are established by the Board of Fisheries under AS 16.05.251 or the 08 Board of Game under AS 16.05.255, each board shall manage land under the 09 Department of Fish and Game's authority to prevent, to the greatest practical extent 10 any net loss of acreage available for sport, subsistence, and commercial fishing, sport 11 and subsistence hunting, and trapping opportunities. 12 (b) Not later than March 31 of each year, the commissioner of fish and game 13 shall submit a report to the legislature describing land managed by the department that 14 (1) was closed to sport, subsistence, and commercial fishing, sport and

01 subsistence hunting, and trapping the previous year and the reasons for the closures; 02 and 03 (2) was opened to sport, subsistence, and commercial fishing, sport 04 and subsistence hunting, and trapping to comply with the no-net-loss-of-acreage 05 provision of (a) of this section. 06 * Sec. 2. AS 38.04.065 is amended by adding new subsections to read: 07 (j) The commissioner shall 08 (1) keep land managed by the Department of Natural Resources open 09 for sport, subsistence, and commercial fishing, sport and subsistence hunting, and 10 trapping unless the department determines the land must be closed for reasons of 11 public safety, fish or game management, or homeland security, or as otherwise 12 required by law; 13 (2) manage land under the authority of the Department of Natural 14 Resources to support, promote, and enhance sport, subsistence, and commercial 15 fishing, sport and subsistence hunting, and trapping opportunities to the extent 16 authorized by state law; 17 (3) manage land under the authority of the Department of Natural 18 Resources to prevent, to the greatest practical extent, any net loss of acreage available 19 for sport, subsistence, and commercial fishing, sport and subsistence hunting, and 20 trapping opportunities. 21 (k) Not later than March 31 of each year, the commissioner shall submit a 22 report to the legislature describing land managed by the Department of Natural 23 Resources that, during the previous year, was 24 (1) closed to sport, subsistence, and commercial fishing, sport and 25 subsistence hunting, and trapping, and the reasons for the closures; and 26 (2) opened to sport, subsistence, and commercial fishing, sport and 27 subsistence hunting, and trapping to comply with the no-net-loss-of-acreage provision 28 in (j)(3) of this section.
