00 HOUSE BILL NO. 128 01 "An Act relating to introduction of measures and to fiscal notes for measures." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 24.08.035(b) is amended to read: 04 (b) In addition to the fiscal note required by this section, the prime sponsor of 05 a bill or resolution, or all joint prime sponsors acting together, may prepare a fiscal 06 note in conformity with the requirements of this section and submit it to the committee 07 of first referral or the finance committee. A committee may prepare an additional 08 fiscal note in conformity with the requirements of this section. 09 * Sec. 2. AS 24.08.035(c) is amended to read: 10 (c) A fiscal note for a bill or resolution must contain the following 11 information: 12 (1) the fiscal impact on existing programs; 13 (2) the fiscal impact of new programs or activities; 14 (3) a line item detail of the fiscal impact; 15 (4) the source of funds expected to be used [UTILIZED] by general

01 fund source, federal fund source, or other identified source; 02 (5) the number of new positions that may be required, identified as 03 full-time, part-time, or temporary; 04 (6) an analysis of how the figures in the fiscal note were derived; 05 (7) additional information necessary to explain the fiscal note; 06 (8) a fiscal impact projection for the current fiscal year and for the 07 succeeding five fiscal years; and 08 (9) formal information consisting of 09 (A) the bill or resolution number; [,] 10 (B) the name of the prime sponsor or the names of the joint 11 prime sponsors; [,] 12 (C) the date the fiscal note was prepared; [,] 13 (D) the name of the committee requesting the fiscal note; [,] 14 (E) the name, electronic mail address, and telephone 15 [PHONE] number of the person who prepared the fiscal note; [,] and 16 (F) the budget request unit, program, or subprogram affected. 17 * Sec. 3. AS 24.08.035(d) is amended to read: 18 (d) The original of a fiscal note shall be submitted to the Division of 19 Legislative Finance and copies shall be sent to the prime sponsor or to each of the 20 joint prime sponsors, the committee requesting the fiscal note, and the office of 21 management and budget. 22 * Sec. 4. AS 24.08.050 is amended to read: 23 Sec. 24.08.050. Prefiling of bills and resolutions. Any member of the 24 legislature whose term extends into a forthcoming regular session [OR 25 LEGISLATURE], or a member-elect, may request [FILE] a bill or resolution or a 26 proposal for a bill or resolution for prefiling as prime sponsor from [WITH] the 27 Legislative Affairs Agency at any time before January 1. A group of members or 28 members-elect may request a measure for prefiling as joint prime sponsors. The 29 agency shall place a prefiled bill or resolution, which is approved by the prime 30 sponsor or by all joint prime sponsors, in proper form and deliver it to the chief clerk 31 or secretary of the appropriate house on the day on which the next session convenes

01 or is organized for business. Prefiled bills or resolutions shall be considered as 02 introduced on the day of their delivery to each house. 03 * Sec. 5. AS 24.08.060 is amended to read: 04 Sec. 24.08.060. Introduction of measures [BILLS]. (a) A member of the 05 legislature, a group of members, or a committee chair [CHAIRMAN], with the 06 concurrence of a majority of the active members of the committee and on behalf of the 07 committee, may introduce a bill or resolution. Bills and resolutions shall be prepared 08 and introduced in the manner and form prescribed in the uniform rules and the 09 legislative style manual. 10 (b) Measures [BILLS] introduced by the legislative council shall be delivered 11 with a letter of explanation to the rules committee of either house and bear the 12 inscription "Rules Committee by Request of the Legislative Council." Measures [; 13 BILLS] introduced by the Administrative Regulation Review Committee shall be 14 delivered with a letter of explanation to the rules committee of either house and bear 15 the inscription "Rules Committee by Request of the Administrative Regulation 16 Review Committee." Measures [; BILLS] introduced by the Legislative Budget and 17 Audit Committee shall be delivered with a letter of explanation to the rules committee 18 of either house and bear the inscription "Rules Committee by Request of the 19 Legislative Budget and Audit Committee." Measures [BILLS] presented by the 20 governor shall be delivered with a letter to the rules committee of either house and 21 bear the inscription "Rules Committee by Request of the Governor." They [; BILLS 22 SO PRESENTED AND INSCRIBED] shall be received as measures [BILLS] 23 carrying the approval of the governor as to policy and budget impact. The governor 24 may submit a statement of purpose and effect with each measure [BILL] and appear 25 personally or through a representative before any committee considering the 26 proposed legislation.
