00 HOUSE BILL NO. 29 01 "An Act increasing the minimum wage; and providing for an effective date." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 23.10.065(a) is repealed and reenacted to read: 04 (a) Except as provided in (b) of this section and as otherwise provided by law, 05 for hours worked in a pay period, whether the work is measured by time, piece, 06 commission, or otherwise, an employer shall pay to each employee wages at a rate that 07 is not less than the higher of $7.15 an hour or, for work performed on or after the 08 effective date of an actual increase of the federal minimum wage to a rate higher than 09 $7.15 an hour, 50 cents an hour more than the federal minimum wage. An employer 10 may not apply tips or gratuities bestowed on employees as a credit toward payment of 11 the minimum hourly wage required by this section. Tip credit as defined by the Fair 12 Labor Standards Act of 1938 as amended does not apply to the minimum wage 13 established by this section. 14 * Sec. 2. This Act takes effect July 1, 2009.
