00 HOUSE BILL NO. 18 01 "An Act increasing the amount of the 2009 permanent fund dividend for certain 02 individuals; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section 05 to read: 06 ALASKA RESOURCE REBATE. (a) To ensure that all residents of the state have an 07 ample opportunity to receive an Alaska resource rebate, the amount of the 2009 permanent 08 fund dividend for those individuals who did not receive a 2008 permanent fund dividend shall 09 be increased. After calculating the amount of the 2009 dividend under AS 43.23.025, the 10 commissioner of revenue shall add $1,200 to determine the total amount of that dividend for 11 the individuals who did not receive a 2008 dividend. 12 (b) An individual who did not receive a permanent fund dividend for 2008 may elect 13 not to receive the $1,200 resource rebate authorized under (a) of this section or may elect to 14 receive only the $1,200 resource rebate and not the balance of the 2009 dividend. The

01 individual shall provide notice of an election under this subsection on a form provided by the 02 Department of Revenue. Notice must be postmarked or received by the Department of 03 Revenue not later than March 31, 2009. 04 (c) Subject to appropriation, the amount necessary for resource rebates to increase the 05 2009 permanent fund dividends under (a) of this section for some individuals shall be 06 transferred from the general fund to the dividend fund (AS 43.23.045). 07 (d) When issuing checks or pay warrants associated with a direct deposit to residents 08 receiving a permanent fund dividend, the commissioner of revenue shall include the following 09 statement in bold type: "This payment includes a resource rebate of $1,200, which is a one- 10 time payment to qualified Alaskans." 11 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
