00 SENATE BILL NO. 108 01 "An Act relating to security video surveillance of legislative space." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 24.05 is amended by adding a new section to read: 04 Sec. 24.05.195. Security video surveillance. (a) To avoid security risks and to 05 deter and prevent unauthorized entries, theft, destruction of equipment, and other 06 criminal activity, the legislative council may provide for security video surveillance in 07 office or other space under the control of the legislature. Security video surveillance 08 must be conducted in a manner consistent with law and with respect for the privacy of 09 persons using legislative facilities. Surveillance camera operators may not monitor 10 individuals based on personal interest or on characteristics of race, gender, ethnicity, 11 religion, sexual orientation, disability, political affiliation, or other factors that are not 12 based on legitimate security or law enforcement goals. 13 (b) Information regarding a security video surveillance system installed under 14 this section is confidential. Footage and other materials produced through the use of 15 security video surveillance are not public records.

01 (c) Except as provided under (d) and (e) of this section, only security officers 02 employed by the Legislative Affairs Agency may have access to footage, screen shots, 03 printouts of screen shots, or other security video surveillance materials. 04 (d) If a security officer who has inspected security video surveillance material 05 determines that a security risk or law enforcement issue may exist, the security officer 06 shall inform the chair of the Legislative Council, or, if the chair is not available, the 07 speaker of the house of representatives and the president of the senate. The chair or the 08 two presiding officers may inspect the security surveillance material that gives rise to 09 the security or law enforcement concern, or may designate another legislator or other 10 legislators to do so. A legislator who inspects the material may elect to provide the 11 material to the legislative council. The council may take any action to address the 12 security risk or law enforcement issue, including providing access to the material to 13 any other person. 14 (e) If a security officer or legislator who has inspected security video 15 surveillance material under (d) of this section determines to a high degree of 16 probability that the material reveals a serious security risk or criminal activity, the 17 security officer or legislator may notify a peace officer, permit inspection of the 18 material by the peace officer, and permit the peace officer to take the material for the 19 purpose of conducting a security or criminal investigation. In this subsection, "peace 20 officer" has the meaning given in AS 01.10.060. 21 (f) Footage, screen shots, printouts of screen shots, and other security video 22 surveillance material in the possession of the Legislative Affairs Agency or the 23 legislative council shall be stored in a secure manner. The material may be retained 24 not longer than 30 days and must then be erased or destroyed unless retention for a 25 longer period is ordered by the legislative council because it finds that the material is 26 or may become relevant to a security or criminal investigation or to a court 27 proceeding.
