00 HOUSE BILL NO. 113 01 "An Act relating to the prescription and use of pharmaceutical agents, including 02 controlled substances, by optometrists." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 08.72.272(a) is amended to read: 05 (a) A licensee may prescribe and use a pharmaceutical agent including a 06 controlled substance, as defined in AS 11.71.900, in the practice of optometry if 07 (1) the pharmaceutical agent is not a schedule IA controlled 08 substance, as defined in AS 11.71.900; 09 (2) the pharmaceutical agent is prescribed and used for the 10 treatment of ocular disease or conditions, ocular adnexal disease or conditions, or 11 emergency anaphylaxis; 12 (3) the person has on file with the department the person's current 13 federal Drug Enforcement Administration registration number that is valid for 14 the controlled substance prescribed or used [A DRUG TOPICALLY APPLIED TO

01 THE HUMAN EYE AND ITS APPENDAGES]; and 02 (4) [(2)] the person holds a license endorsement issued by the board 03 authorizing the prescription and use of pharmaceutical agents under this subsection. 04 * Sec. 2. AS 08.72.272(c) is amended to read: 05 (c) A licensee may use a pharmaceutical agent in the practice of optometry if 06 (1) the pharmaceutical agent is a drug topically applied to the human 07 eye and its appendages; and 08 (2) the person holds a license endorsement issued by the board 09 authorizing the use of the pharmaceutical agent under this subsection.
