00 SENATE BILL NO. 208 01 "An Act requiring hospitals to collect data and disclose reports of hospital-acquired 02 infections; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 18.20 is amended by adding a new section to read: 05 Sec. 18.20.076. Hospital data collection and reporting. (a) A hospital shall 06 collect data on all hospital-acquired infection rates for 07 (1) surgical site infections; 08 (2) ventilator-associated pneumonia; 09 (3) central-line-related bloodstream infections; 10 (4) urinary tract infections; and 11 (5) other categories of infections as adopted by the department by 12 regulation. 13 (b) A hospital shall, after collecting data required under (a) of this section, 14 prepare and disclose quarterly reports to the public in a format required by the

01 department by regulation. Data included in a quarterly report 02 (1) must cover a period ending not earlier than one month before 03 submission of the report; 04 (2) may not contain confidential patient information; and 05 (3) must disclose information in a way that does not identify an 06 individual who was involved in an incident of infection. 07 (c) A quarterly report prepared under (b) of this section is a public record. The 08 department shall cause each quarterly report to be posted at the hospital that submitted 09 the report and to be available upon request. 10 (d) If a hospital is a division or subsidiary of another entity that owns or 11 operates other hospitals or related organizations, the quarterly report required under 12 this section shall be prepared separately for each division or subsidiary. 13 (e) In this section, "hospital-acquired infection" means a localized or systemic 14 condition that results from an adverse reaction to the presence of an infectious agent or 15 agents or its or their toxin or toxins that were not present or incubating at the time of 16 admission to the hospital. 17 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 18 read: 19 TRANSITION: REGULATIONS. The Department of Health and Social Services may 20 proceed to adopt regulations necessary to implement sec. 1 of this Act. The regulations take 21 effect under AS 44.62 (Administrative Procedure Act), but not before the effective date of the 22 statutory change. 23 * Sec. 3. Section 1 of this Act takes effect July 1, 2007.
