00 SENATE BILL NO. 64 01 "An Act relating to the pay of members of the Alaska National Guard and Alaska Naval 02 Militia while in active service primarily as a labor force." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 26.05.260(b) is amended to read: 05 (b) Members of the Alaska National Guard and Alaska Naval Militia are 06 entitled to receive, for each day of active service under AS 26.05.070, 07 (1) except for active service as described in (2) of this subsection, 08 pay equal to 200 percent of the minimum daily basic pay provided by federal laws and 09 regulations for members of equivalent grades of the United States armed forces; 10 however [. HOWEVER], a member may not receive less than $105 a [PER] day for 11 active service performed during the fiscal year ending June 30, 2000, and for [. FOR] 12 fiscal years beginning after June 30, 2000, the minimum payment of $105 shall be 13 increased one percent for each percent increase in the consumer price index for 14 Anchorage, Alaska, as determined by the United States Department of Labor, Bureau

01 of Labor Statistics, not to exceed an annual increase of four percent; the [. THE] 02 increase authorized by this paragraph, if any, takes effect not more than 30 days 03 after the release of the consumer price index; for that purpose, the [. THE] consumer 04 price index that is published immediately after July 1, 1999, is the reference base 05 index; 06 (2) during which the members perform in active service primarily 07 as a labor force, pay equal to that received by the main labor force in service of 08 the state or federal government performing services as a labor force; the adjutant 09 general shall, by regulations adopted under AS 44.62, define "active service 10 primarily as a labor force" for purposes of this paragraph; the regulations may 11 include within the definition, by way of example and not limitation, service by the 12 members to fight fires, combat a flood, or perform in the relief of another 13 emergency or disaster. 14 * Sec. 2. AS 26.05.330(e) is amended to read: 15 (e) For each day of duty as a member of a general court-martial, or as a 16 witness under summons from the president or judge advocate of the court, officers and 17 enlisted persons shall be paid as provided in AS 26.05.260(b)(1) [AS 26.05.260(b) 18 AND (c)].
