00 HOUSE BILL NO. 464 01 "An Act relating to the possession of the edible meat of big game animals." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 16.30 is amended by adding a new section to read: 04 Sec. 16.30.013. Retention of horns or antlers. (a) Subject to (b) of this 05 section, a person who takes a big game animal may retain the horns or antlers of the 06 animal if, at the first point of arrival from the field, the person 07 (1) possesses at least 50 percent of the edible meat of the animal; or 08 (2) has delivered that portion of the edible meat of the animal not 09 possessed by the person to another person and possesses a written document signed by 10 the recipient of the meat stating the quantity of edible meat received. 11 (b) A person may not retain the horns or antlers of a big game animal if the 12 person is convicted of a violation of AS 16.30.012 for failing to possess the edible 13 meat of that big game animal. 14 (c) Unless the person is authorized under (a) of this section to retain the horns 15 or antlers, a person who takes a big game animal and removes the horns or antlers of

01 the animal from the field shall deliver the horns or antlers to the department. 02 (d) For purposes of this section, it is presumed that a person possesses at least 03 50 percent of the edible meat of a big game animal if the quantity of edible meat 04 possessed by a person equals or exceeds 50 percent of the edible meat reasonably 05 expected to be recovered from the big game animal as may be determined by the board 06 by regulation. 07 (e) In this section, 08 (1) "delivered" has the meaning given in AS 16.30.017; 09 (2) "field" has the meaning given in AS 08.54.790. 10 * Sec. 2. AS 16.30.017(b) is amended to read: 11 (b) It is a defense to a criminal charge under AS 16.30.012 that the defendant 12 does not possess the edible meat of the big game animal because the meat was 13 (1) consumed by human beings; or 14 (2) delivered to another person; the delivery of edible meat to 15 another person must be documented in writing by a statement signed by the 16 recipient of the meat that states the quantity of edible meat received.
