01 "An Act relating to aggravating factors at sentencing."                                                                 
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 12.55.155(c) is amended by adding a new paragraph to read:                                        
04                 (33)  the offense was a felony specified in AS 11.41.410 - 11.41.455                                    
05       and the defendant had been previously diagnosed as having or having tested positive                               
06       for HIV or AIDS; in this paragraph, "HIV" and "AIDS" have the meanings given in                                   
07       AS 18.15.310.                                                                                                     
08    * Sec. 2.  The uncodified law of the State of Alaska is amended by adding a new section to                         
09 read:                                                                                                                   
10       APPLICABILITY.  This Act applies to offenses occurring on or after the effective                                  
11 date of this Act.
