00 HOUSE BILL NO. 255 01 "An Act making appropriations for the construction, repair, upgrade, and refurbishing 02 of sport fish hatcheries; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. FAIRBANKS SPORT FISH HATCHERY. Subject to sec. 4 of this Act and 05 contingent upon the Department of Fish and Game entering into a contract or other agreement 06 that ensures a supply of warm water to satisfy the needs of the sport fish hatchery at Fairbanks 07 for the initial 15 years of operation of the hatchery, the sum of $15,000,000 is appropriated to 08 the Department of Fish and Game for construction of a sport fish hatchery at Fairbanks from 09 the income earned on that portion of the money received by the state as a result of State v. 10 Amerada Hess, et al., 1JU-77-847 Civ. (Superior Court, First Judicial District) that was 11 deposited into the principal of the Alaska permanent fund. It is the intent of the legislature 12 that the construction of the hatchery not displace public recreation areas and that the hatchery 13 be named the Ruth Burnett Sport Fish Hatchery. 14 * Sec. 2. EXISTING STATE HATCHERIES. Subject to sec. 4 of this Act, the sum of

01 $15,000,000 is appropriated to the Department of Fish and Game for repair, upgrade, and 02 refurbishing of existing state sport fish hatcheries from the income earned on that portion of 03 the money received by the state as a result of State v. Amerada Hess, et al., 1JU-77-847 Civ. 04 (Superior Court, First Judicial District) that was deposited into the principal of the Alaska 05 permanent fund. The money appropriated by this appropriation must first be committed to the 06 repair and upgrade of the state hatcheries at Fort Richardson and Elmendorf Air Force Base, 07 including the replacement of the heating system. The balance of the appropriation remaining 08 after sufficient money has been allocated for the repair, upgrade, and refurbishing of the state 09 hatcheries at Fort Richardson and Elmendorf Air Force Base may be used by the department 10 for repair, upgrade, and refurbishing of other state sport fish hatcheries. 11 * Sec. 3. LAPSE. The appropriations made by this Act are for capital projects and lapse 12 under AS 37.25.020. 13 * Sec. 4. CONTINGENCY. The appropriations made by secs. 1 and 2 of this Act are 14 contingent upon the enactment into law of a bill repealing AS 37.13.145(d) or amending 15 AS 37.13.145(d) to eliminate the requirement that the income earned on that portion of the 16 money received by the state as a result of State v. Amerada Hess, et al., 1JU-77-847 Civ. 17 (Superior Court, First Judicial District) that was deposited into the principal of the Alaska 18 permanent fund, be deposited into the principal of the Alaska permanent fund. 19 * Sec. 5. This Act takes effect July 1, 2005.
