00 HOUSE BILL NO. 139 01 "An Act relating to the voting rights of felons; and providing for an effective date." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 15.05.030 is amended to read: 04 Sec. 15.05.030. Loss and restoration of voting rights. (a) A person 05 convicted of a crime that constitutes a felony [INVOLVING MORAL TURPITUDE] 06 under state or federal law and who is incarcerated as a result may not vote in a state, 07 federal, or municipal election [FROM THE DATE OF THE CONVICTION 08 THROUGH THE DATE OF THE UNCONDITIONAL DISCHARGE OF THE 09 PERSON]. Upon release from incarceration [THE UNCONDITIONAL 10 DISCHARGE], the person may register under AS 15.07. 11 (b) The commissioner of corrections shall establish procedures by which a 12 person released from incarceration [UNCONDITIONALLY DISCHARGED] is 13 advised of the voter registration requirements and procedures. 14 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 15 read:

01 CONDITIONAL EFFECT OF ACT. This Act takes effect only if a constitutional 02 amendment changing the voting rights of felons to permit all but those felons in state or 03 federal custody to vote is passed by the legislature and approved by the voters at the 2006 04 general election. 05 * Sec. 3. If this Act takes effect under sec. 2 of this Act, it takes effect on the effective date 06 of the amendment described in sec. 2 of this Act.
