00 HOUSE CS FOR CS FOR SENATE BILL NO. 300(JUD) 01 "An Act relating to an attorney's lien, to court actions, and to other proceedings where 02 attorneys are employed; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 34.35.430(b) is repealed and reenacted to read: 05 (b) The lien described in (a) of this section is superior to all subsequent liens 06 except tax liens. The lien is a charge on the action, and the parties to the action may 07 not extinguish or affect the attorney's lien by any means, including settlement, other 08 than by satisfying the underlying claim of the attorney for the fees and costs incurred 09 in connection with the action. Nothing in this subsection precludes a party from 10 contesting an attorney's lien under applicable law. 11 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 12 read: 13 APPLICATION. AS 34.35.430(b), as repealed and reenacted by sec. 1 of this Act, 14 applies to an attorney's lien served and filed in a court action or other proceeding on or after
01 the effective date of this Act. 02 * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
